Terms and Conditions
Good Evans Pilates & Ski is a wholly owned subsidiary of aqualetica GmbH.
Good Evans provides its products and services, in particular those involving physical activity, only to persons who are registered as Clients. You may become a Client by completing the relevant application form and being accepted by Good Evans as a Client. If you are under 18, we will require written consent from your parents or guardians together with your application.
Good Evans has sole discretion to decide whether or not to accept an application to become a Client, and whether to continue to provide products or services to existing Clients. In exceptional circumstances Good Evans may decide to terminate its relationship with a Client altogether; in this case Good Evans shall reimburse the Client any monies received from the Client for products or services that Good Evans has not yet provided or reasonably made available to the Client.
Booking, Payment and Cancellations
Booking
Good Evans’ standard products and services together with their prices are set out on the website www.goodevans.ch. Additional or bespoke products and services are available to suit Clients’ individual needs; please do not hesitate to ask.
Good Evans’ products and services can be booked via the website, by email or directly with Good Evans staff. Bookings are firm only when confirmed by email/whatsapp by Good Evans’, including time, location and price.
Payment
Payment for Good Evans’ products and services can be made in cash or by card through sumup at the time the products and services are provided, or by bank transfer within 10 days of receiving an invoice.
In some circumstances, in particular if Good Evans must itself pay costs up front before a booked activity, Good Evans may require a Client to pay some or all of the fees in advance; this will be communicated to the Client at the time of booking. In this case, the booking will not be firm until Good Evans has received the required funds from the Client.
Cancellation by Good Evans
When Good Evans has accepted a booking, Good Evans will make all reasonable efforts to ensure that the requested products and services will be provided to the Client at the agreed time and location. In particular in the case of outdoor activities, Good Evans has sole discretion to determine whether conditions are suitable for the activity to go ahead. If Good Evans cannot provide the products and services as originally agreed, for example due to adverse weather, Good Evans will provide the Client with a choice of up to 3 alternative times and/or locations, as far as is reasonable. If Good Evans cannot provide the product or service at all, Good Evans will reimburse the Client for any monies paid by the Client for the product or service that Good Evans could not provide. In all cases, in case of cancellation by Good Evans, Good Evans shall not be liable to compensate the Client a sum greater than the monies received from the Client for the relevant product or service.
Cancellation by the Client
Unless agreed otherwise, a Client may cancel or amend a booking for a product or service up to 24 hours in advance of the agreed time without penalty. In this case Good Evans will provide the client with a suitable alternative booking or refund any monies already paid by the Client for the specific booking, at the Client’s discretion.
Cancellation by the Client 24 hours or less before the start time of the booked activity will result in the Client being charged in full for the booked activity. Note: this includes situations where at short notice a Client decides not to take part in an outdoor activity giving weather as a reason when Good Evans determines on a reasonable basis that conditions are suitable for the activity to go ahead.
For some products or services, for example for bespoke activities where Good Evans may incur costs in advance of an activity, there may be different cancellation penalties; these will be agreed between Good Evans and the Client in writing at the time of booking.
Packages of activities and gift certificates
Packages of activities and gift certificates provide a Client with credit entitling the Client to book a specified amount of product or services within a time period. Unless otherwise specified in writing, the time period shall commence upon the date of purchase and expire 12 months later. Clients should ensure they use their credit in good time; unused credit will not be refunded.
In exceptional circumstances only, an extension may be provided, for example due to a medically certified health condition unexpectedly arising that reasonably prevents the Client from using the product or services in the time period. This is at Good Evans’ sole discretion.
Fitness and health
It is your sole responsibility to ensure, before and during using Good Evans’ products and services, that you are sufficiently physically fit and that you have no medical condition that would make using Good Evans’ products and services inadvisable.
If you have any questions or concerns regarding the nature of the products and services, in particular those involving physical activity, please do not hesitate to discuss them in advance with Good Evans; our staff will help you understand what each relevant activity will entail. In particular, if you develop any temporary or permanent condition that may limit the physical activities in which you can participate, for example through injury or pregnancy, you must inform Good Evans in advance and we will be happy to discuss with you whether our products or services can be modified to suit your requirements. In this case it is nevertheless essential that you continue to monitor your condition during any activity, and inform Good Evans staff immediately if you have any concerns that the activity is not suitable for your condition; the decision to participate in the activity, and to continue to participate during the activity, remains yours alone. This is equally the case in group activities as well as individual activities.
It is important to understand that our staff cannot give medical advice; if you have any doubts about your physical condition, wellbeing and capability to exercise, we strongly recommend that you first get advice from a qualified medical professional. In particular in the case of pregnancy, we strongly recommend a pregnant woman should discuss with her doctor on a regular basis to what extent physical activity remains suitable for her. Whereas Good Evans may tailor activities to be more suitable for pregnancy in general, a pregnant Client participates in each activity at her own discretion as set out above and at her own risk; Good Evans accepts no liability for any complication relating to pregnancy that occurs during or after an activity. For women who wish to train and get back in shape after a pregnancy, we ask that they do not start sessions until at least their 6 week post-natal check-up, and then only when their doctor states that they can return to exercise.
Notwithstanding the Client’s responsibilities for ensuring their fitness at all times as set out in this section, Good Evans reserves the right for its staff to cease to provide a product or service to a Client at any time if, in its absolute discretion, Good Evans’ staff considers the product or service may impair the Client’s health. This right does not in any way diminish the Client’s own responsibility for ensuring the ongoing suitability for themselves of Good Evans’ products and services.
General
Good Evans Pilates & Ski refers to the company aqualetica gmbh, registered address Bächergässli 50, 8806 Bäch, Switzerland.
These terms and conditions relate to the products and services provided by Good Evans, wherever they are provided, including in the Baechergaessli 50 and deinyogaraum studios, on the water, in a ski resort, via a website, or in any other location.
By using Good Evans’ products and services including its website (URLs: goodevans.ch, goodevanspilates.com, aqualetica.com, aqualetica.ch) you acknowledge that you accept these terms and conditions. If you do not accept these terms and conditions, do not use Good Evans’ products or services, including the website.
Good Evans’ warrants that its products and services will be supplied with reasonable skill and care. Any products purchased will be honoured with the manufacturers guarantee.
Good Evans’ may change these Terms and Conditions from time to time at its sole discretion. These Terms and Conditions shall be governed and interpreted in accordance with Swiss law, and you consent to the jurisdiction of the Swiss courts.

Important Liability Statement
Good Evans reserves the right to make alterations to the sessions, instructors and/or equipment, especially concerning air/water temperature outside using absolute discretion and Good Evans will not be liable for any loss occasioned by such alterations except insofar as such loss is by law incapable of exclusion. It is the Client’s responsibility to ensure that he/she is fit and well and capable of undergoing a routine of exercises in the sessions. Clients accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by our instructors and or through the website at no time constitutes medical advice in substitute for advice provided by a medical professional. It is also vital that you supply us with correct information about yourself. We cannot be liable for any incorrect information supplied by you to us. We try to make sure that all information contained on this web site (and provided by us to you as part of any Services or Products) is correct, but, subject to the paragraph below, we do not accept any liability for any error or omission and exclude all liability for any action you (your legal representatives, heirs) may take or loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information provided through any Service supplied by us to you. You, your legal representatives and your heirs release waive, discharge and covenant, not to sue Good Evans or aqualetica GmbH and its employees for any risks, injury, damages, known or unknown, which they may incur as a result of participating in any of the classes or death caused by their negligence or other acts. You agree that your use of the website and the Service is on an “as is” and “as available” basis. On that basis, except as expressly set out in these terms, Good Evans does not enter into conditions, warranties or other terms in relation to the Site or the Products or the Services (including any implied term relating to quality, fitness for a particular purpose) or any guaranteed or predicted result.
